Terms Of Service

These conditions define the procedure for ordering, paying, delivering and returning the service offered on the website www.adriatic-cloud.hr. The seller of the service offered on this site is Filip informatika d.o.o. (hereinafter: Adriatic Cloud), F. Tuđmana 7a, 21212 Kaštel Sućurac, and the Buyer of the service is a visitor of the online store who selects at least one service, fills in the electronic order form and sends it to the Seller. All listed prices are retail and do not include VAT.

The buyer can register on the website www.adriatic-cloud.hr. Upon registration, the customer is required to enter their own email address and password. The customer must be registered to purchase services through the online store.

The service is ordered exclusively by an electronic order form; basket. If the Seller is not able to deliver certain services, he will notify the buyer by e-mail about the same within a maximum of 3 working days. Ordering the service is possible 24 hours a day, 7 days a week, except in situations where the opposite is stated on the page.

Upon completion of the order, the Buyer will be notified by e-mail of receipt of the order. If payment by bank transfer is selected, the buyer according to the payment information specified in the confirmation e-mail should make the payment within 3 working days to the Seller’s account. If credit card payment is selected, the customer’s credit card is charged for the total amount of the order upon activation of the service.

By accepting these conditions, the User confirms that he is familiar with and accepts the rules of the registry for a specific top-level domain and undertakes to fully comply with them.

The user understands that placing an order for domain registration, domain renewal or transfer does not guarantee that Adriatic Cloud will be able to complete the procedure. The user agrees that when the order can only be partially fulfilled, the agreement is concluded only for successfully executed services. If the ordered domains that the User ordered and paid for are taken by a third party in the meantime, Adriatic Cloud will inform the User about this and offer to register another free domain or refund the paid amount to the payer. Adriatic Cloud bears no responsibility if the paid domain is occupied by a third party in the period between the order and payment, and in case of errors with the API connection to the domain registries that check whether the ordered domain is free.

“Premium” domains are domains that the domain registry reserves in advance as domains of higher (purchasing) value. These domains appear as free domains, but their exact annual fee cannot be known in advance when checking in the order process. If the User orders and pays Adriatic Cloud a “premium” domain that is free in the registry, but does not have a standard supply price like other domains in that TLD, it is a domain with a higher purchase value than the standard price (the so-called “premium” price) , Adriatic Cloud will inform the User about this, and offer him the registration of another standard-price domain instead of a premium domain, or refund the amount paid. Adriatic Cloud bears no responsibility for the situation in which, during domain registration, it turns out that the paid domain is actually a “premium” domain. The domain name cannot be changed after payment and registration.

If the ordered domain contains a trademark to which a third party claims the right, Adriatic Cloud reserves the right to ask the domain orderer for confirmation that he has the right to use the trademark before registering the paid domain. If the User, i.e. the payer, does not have the right to use the trademark, or if the said right cannot be proven, Adriatic Cloud will refuse domain registration and return the amount paid to the payer or offer registration of another domain without the trademark. If Adriatic Cloud registers in the name and for the account of the User a domain that contains a trademark of a third party that the User does not have the right to use, the User bears responsibility for the damage to the third party, and Adriatic Cloud reserves the right to claim compensation from the User in case of co-responsibility.

By accepting these terms, the User also accepts the rights and obligations prescribed by ICANN. ICANN stipulates that the User is obliged to provide real and verifiable contact information for registered domains. When registering or transferring a domain, the registrar (or registrar provider) will require the User to confirm their contact information. The process will require the User to have a valid e-mail address to which the request for verification of contact information will be sent. The user is obliged to confirm his identity by taking the appropriate action described in detail in the e-mail message sent to his designated e-mail address when ordering services. If the User does not take appropriate actions, the registrar is obliged to suspend the domain within 15 days. Adriatic Cloud is not responsible for any damage caused by domain suspension due to non-confirmation of contact information by the User. Adriatic Cloud is also not responsible for the delivery of e-mail messages to the User.

The User agrees and consents to (when it is expressly necessary to fulfill the User’s requirements) the modification of the User’s contact information that is entered in the registry of certain TLDs (top level domains). This includes (but is not limited to) TLDs that require the User to have a local presence in the country of the TLD registry. Adriatic Cloud reserves the right to temporarily (and only for the duration of the domain transfer process) change the contact information for domains in order to transfer the domain between registrars. Adriatic Cloud is obliged to return the contact data immediately after the domain transfer process is completed. If Adriatic Cloud fails to update the contact information in a timely manner, the User is obliged to inform Adriatic Cloud about this and allow a certain period for updating the User’s contact information.

In the period between domain registration and publication of content on the domain, the Adriatic Cloud service can publish any information and content on the domain, either its own or from third parties, especially about its offer and services. The content published by the Adriatic Cloud service must not harm the interests of the User. The Adriatic Cloud service must remove the published content on the domain immediately after the User makes his own content available for publication. Adriatic Cloud service also has the right to publish its contents for domains or hosting for which the User has not paid the bill or has not received a new offer from Adriatic Cloud service.

Domains are registered for a specific lease period, which is usually a year or more, and have an expiration date indicated in the domain registry, after which the domain can be deactivated and/or deleted at any time depending on the procedure prescribed by each top domain registry. . The user is obliged to pay Adriatic Cloud’s domain extension offer by the domain’s expiration date. If the User fails to pay for the domain extension by the domain’s expiration date, Adriatic Cloud is not obliged to provide the service at the same price listed in the offer and may refuse to extend the domain and/or ask for an additional payment due to the higher costs of extending the expired domain, about which it will inform the User in a timely manner. Adriatic Cloud bears no responsibility for damages caused to the User due to the User’s payment for the service after the domain expiration date, which includes (but is not limited to) damages due to inactivity, suspension or deletion of the domain.
The domain name cannot be changed after payment and registration.

PAYMENT BY GENERAL PAYMENT, VIRMAN OR INTERNET BANKING

The buyer is obliged to make the payment by general payment slip or internet banking within 24 hours from the moment of the order. In the reference number it is necessary to state HR00 – order number, and payment is made to IBAN HR2625030071148002017 opened with Sberbank d.d. Upon receipt of payment, the ordered Service will be activated.

CREDIT CARD PAYMENT

On the BlueSnap page, select the type of credit card you are paying with and enter the required information. Once you confirm your purchase, you will see a confirmation of your order that will be sent to your email address. The BlueSnap system will send you an email confirmation of your card authorization for the specified amount. For your protection, the BlueSnap system does not allow us to charge more than the authorized amount or to view your credit card number.

We are committed to protecting the privacy of all our customers. We collect only the necessary basic information about the customers of web stores needed to carry out transactions and orders. All user data is strictly kept and is available only to Adriatic Cloud webshop employees who are responsible for respecting the principles of privacy protection.

When paying with cards in our web store, use BlueSnap – an advanced system for secure acceptance of payment cards via the Internet.

BlueSnap ensures the complete confidentiality of your card data from the moment you enter it in the BlueSnap payment form. Payment information is forwarded encrypted from your web browser to the bank that issued your card. Adriatic Cloud never comes into contact with complete information about your payment card. Also, the data is inaccessible even to BlueSnap system employees. The isolated core independently transmits and manages sensitive data, keeping it completely secure.

BlueSnap complies with the Level 1 Payment Card Industry Data Security Standards (PCI-DSS), which are the highest standards in the industry. BlueSnap meets all the requirements for online payment security prescribed by leading card brands.

Dear customers, we would like to inform you about how to file a consumer complaint. Pursuant to the Consumer Protection Act, you can submit a complaint about the quality of our services in writing to the address: Adriatic Cloud, F. Tuđmana 7a, 21212 Kaštel Sućurac or by e-mail to support@adriatic-cloud.com 

The consumer may, without stating a reason, unilaterally terminate this contract, within 14 days from the day of concluding the contract or upon its receipt. In order to exercise the right to unilateral termination, the consumer must provide the trader with a written notice stating that he is terminating the contract at the address:

The notice must be written on a durable medium and may be delivered as a letter sent by mail or e-mail. If the consumer exercises his right to unilateral termination, he will not bear the costs incurred in this connection, except for the possible costs of licenses, domains, SSL certificates and other services leased from third parties for which an automated refund is not possible. Adriatic Cloud will make every effort to ensure a refund for services leased from third parties, domains, SSl certificates, but does not guarantee a refund.

Refunds can only be made after the service has been deactivated. Confirmation of receipt of notification of unilateral termination of the contract will be sent to you, without delay, by e-mail.

Replacement of the service is possible for all hosting services within 14 working days from the activation of the service. The request for replacement of the service must be sent together with a copy of the invoice to the address:

The buyer has the right to make a complaint within the warranty period. Complaints are sent to the address:

A complaint is considered valid if it meets the conditions for complaint in accordance with the Law on Obligations and the Law on Consumer Protection. The Seller is obliged to replace the service or return the entire amount paid less any costs of licenses, domains, SSL certificates and other services leased from third parties for which no automated refund is possible within 15 days of receiving a valid complaint to the Buyer. Adriatic Cloud will make every effort to ensure a refund for services leased from third parties, domains, SSl certificates, but does not guarantee a refund.

Adriatic Cloud undertakes to use all collected personal data exclusively for identification purposes when using the Adriatic Cloud online store. Adriatic Cloud undertakes to keep your data confidential and will not distribute, publish, give it to third parties or make it available to any third party without your prior consent.

By visiting the online store www.adriatic-cloud.hr, you agree to communicate in electronic form and all agreements, notices, announcements and other content submitted in electronic form meet the legal framework as if they were in writing.

Adriatic Cloud reserves the right to update and change these Terms of Purchase without prior notice, provided that these changes take effect upon publication on this website and apply to all purchases from the date of entry into force of the new Terms of Purchase.

Adriatic Cloud makes every effort to keep the information on the web store website up-to-date and accurate. Adriatic Cloud cannot guarantee the 100% accuracy of all displayed information about products and services. In exceptional cases, discrepancies between actual data and data available on the website are possible. In each such case, Adriatic Cloud undertakes to revise the order and agree on alternatives with the customer. Likewise, photographs of services do not always correspond to services and should only be construed as an informative illustration.

We will consider the complaint valid if we determine that it meets the conditions for a complaint in accordance with the Civil Obligations Act and the Consumer Protection Act. In this case, we will replace the service or refund the full amount paid within 15 days of receiving a valid complaint. Before sending a complaint, please contact us at support@adriatic-cloud.com
